After originally saying he should keep the case, Lockport Town Justice Leonard Tilney decided to step aside in the proceedings against Town Attorney Daniel Seaman on Tuesday.

Tilney issued a written opinion saying that it'd be best for all parties if he handed the case off.

Seaman was arrested on a charge of driving while intoxicated on March 30 after his pickup truck was spotted in the mud on Crosby Road. He refused to submit to chemical tests at the time.

Seaman is a partner at a City of Lockport law firm, and also represents the Towns of Hartland, Pendleton and the Niagara County Water District.
