A cousin and eyewitness took the stand on Wednesday in the trial of a twin who allegedly murdered a Niagara Falls man last year. Demetrius Hayes said 32-year-old Edward Nickens shot his cousin Joshua Hayes in the face from six inches away after a fight.
Nickens insists he wasn't the shooter and Hayes originally identified his twin brother as the killer.
Defense attorney Frank LoTempio has claimed that Hayes, his cousin and others were trying to attack Nickens in what he termed a gang assault. Testimony continues today in the trial.
