Opening arguments in McCoy case today

The murder trial of a Rochester man who is accused of shooting and killing a man in the Falls during an apparent robbery attempt starts today with opening statements in Lockport.

28-year-old Earl McCoy faces six counts, including second-degree murder, after the killing of Buffalo's Jacobi Lovett in 2009.

Defense attorney John Parrinello has twice asked for a mistrial, once in response to comments by Niagara County Court Judge Matthew Murphy and the second time because he said there were "no blacks" on the jury.

Another man, 24-year-old Tyrome Elder of the Falls, was convicted of the same charges in March.
