New York State has been barred from collecting taxes on the sale of tobacco to non-Native Americans on Seneca Nation land.

A State Supreme Court Judge issued a temporary restraining order Tuesday that will remain in place until she hears arguments in the case on June .

The move comes one day after a federal court gave the state a go-ahead to begin collecting taxes on cigarette sales by Native American retailers to non-Native Americans, a move many tobacco businesses have claimed will force them to shut down.
