State Police arrested MARLOWE J. SMITH of Niagara Falls for Felony DWI including 2 counts of Aggravated DWI/Leandra's Law and Aggravated DWI on Monday night.

SMITH had two children under the age of 16 in the vehicle when he was stopped for speeding on Hyde Park Blvd. in Niagara Falls. 

Smith's BAC was .24 percent. Hes being held without bail awaiting arraignment today.
